Dr. Leandro MancanoUniversity of Edinburgh, United Kingdom
Organised by Dr. Auke Willems (FRC)Introduced by Prof. Dr. Anne Weyembergh (ULB)
Introduction
The presentation will focus on the following aspects of Brexit and criminal justice in Scotland:
i) Key EU legislative instruments implemented in Scots law have enhanced individual protections, when compared to the previous legal framework. They relate to rights for suspects and defendants in criminal proceedings and rights of victims of crime. Strategies for preserving these rights following Brexit will be discussed.
ii) The challenges posed by ending participation in other key criminal justice tools, notably the European Arrest Warrant, and the European Investigation Order, as well as ending participation in Eurojust.
iii) Possible frictions in areas where devolved and reserved matters intersect and the consequent need for enhanced cooperation.
